Virginia Congress Continues Gun Control Frenzy with 9 More Bills, Ignores Massive Protest

Despite a massive and peaceful turnout on the Lobby Day rally on January 20th, the Virginia State Congress remained totally unphased by what the people wanted and proceeded to advance numerous unconstitutional gun laws over the following week.

While everyone has been focused on the Wuhan coronavirus, state lawmakers have been quietly eroding gun rights.

“Red Flag” gun law passed

Proving they don’t care at all about the opinions of the people of Virginia, the state’s Senate passed a “red flag” gun law only two days later. Here’s the summary of SB240.

Creates a procedure by which any attorney for the Commonwealth or any law-enforcement officer may apply to a general district court, circuit court, or juvenile and domestic relations district court judge or magistrate for an emergency substantial risk order to prohibit a person who poses a substantial risk of injury to himself or others from purchasing, possessing, or transporting a firearm. If an emergency substantial risk order is issued, a judge or magistrate may issue a search warrant to remove firearms from such person.

An emergency substantial risk order shall expire on the fourteenth day following issuance of the order. The bill requires a court hearing in the circuit court for the jurisdiction where the order was issued within 14 days from issuance of an emergency substantial risk order to determine whether a substantial risk order should be issued.

Seized firearms shall be retained by a law-enforcement agency for the duration of an emergency substantial risk order or a substantial risk order or, for a substantial risk order and with court approval, may be transferred to a third party 21 years of age or older chosen by the person from whom they were seized. The bill allows the complainant of the original warrant to file a motion for a hearing to extend the substantial risk order prior to its expiration. The court may extend the substantial risk order for a period not longer than 180 days.

The bill provides that persons who are subject to a substantial risk order, until such order has been dissolved by a court, are guilty of a Class 1 misdemeanor for purchasing, possessing, or transporting a firearm; are disqualified from having a concealed handgun permit; and may not be employed by a licensed firearms dealer. The bill also provides that a person who transfers a firearm to a person he knows has been served with a warrant or who is the subject of a substantial risk order is guilty of a Class 4 felony. The bill creates a computerized substantial risk order registry for the entry of orders issued pursuant to provisions in the bill. (source)

Of course, we all know the dangers of red flag gun laws. Anyone can swear out a complaint against a gun owner – including an abuser who doesn’t want his victim to be able to protect herself or himself. Add to that, numerous law-abiding citizens have been killed when police burst in to serve the warrant and seize the gun owner’s firearms.

But that’s not all that Virginia has in store for gun owners.

Also two days after the rally of gun owners, the Senate Judiciary Committee advanced a proposed new law that would make it more difficult for Virginians to get a concealed carry permit in the form of SB263.

Concealed handgun permits; demonstration of competence. Removes the option for concealed handgun permit applicants to demonstrate competence with a handgun by completing an electronic, video, or online course conducted by a state-certified or National Rifle Association-certified firearms instructor. The bill does not affect any in-person means of satisfying the requirement to demonstrate competence with a handgun under current law. (source)

Obviously, this makes it more difficult for rural residents to take the required training and it makes it more expensive for poverty-stricken gun owners.

On Friday the House advanced the following bills to the Senate for further approval.

HB2 would criminalize the private transfer of firearms in the Commonwealth. Unlike SB70, which was passed by the Senate, HB2 would criminalize almost all firearm transfers – not just sales. Under this extreme legislation, even lending a brother your rifle for a deer hunt or letting your daughter borrow a handgun for self-defense could land otherwise law-abiding Virginians with a felony conviction and up to 5 years in jail. Additionally, the recipient could face up to a full year of incarceration.

HB674 would create a “red flag” gun confiscation procedure that is similar to that created by SB240. Just like the senate bill, HB674 would empower the government to strip an individual’s constitutional right to keep and bear arms and seize their firearms pursuant to an ex parte order. However, whereas SB240 would require a commonwealth’s attorney or two law enforcement officer to petition the court, HB674 provides even less safeguards – allowing a single law enforcement officer to petition for a confiscation order.

HB812 would ration the right to keep and bear arms by limiting Virginians to one handgun purchase per 30-day period. Unlike SB35, which has passed the full Senate, HB812 does not provide an exemption to this restriction for CHP holders.

From 1993 to 2012, Virginia had a “one-handgun-a-month” law that rationed the number of handguns law-abiding gun owners could purchase to one a month. In 1993, Gov. L. Douglas Wilder and other gun control advocates sold the handgun rationing measure as a way to curb gun trafficking from Virginia to more restrictive Northeast states, particularly New York. HB812 comes along after New York City billionaire and gun control financier Michael Bloomberg spent an exorbitant sum in the 2019 election cycle. According to ATF Trace data, there were fewer firearms traced to Virginia in the three years after the law was repealed than in the three years prior to repeal.

HB9 would re-victimize burglary and robbery victims by penalizing a crime victim who fails to report the theft of a firearm to law enforcement within 24 hours of discovering the theft. These victims would be fined up to $250.

In the aftermath of a burglary, victims are occupied with a host of concerns. The first and foremost concern is the physical safety and well-being of themselves and their loved ones. To place an additional burden on crime victims in their moment of despair is the ruthless act of a callous state that exhibits no regard for the hardship victims face as they put their lives back together.

HB412 would eliminate Virginia’s state firearms preemption law. Current law ensures that those living and traveling throughout Virginia are subject to the same predictable state statutes wherever they are in the Commonwealth. With this regimen, law-abiding gun owners can move about the state without fear of being ensnared by a confusing patchwork of disparate local ordinances. Unable to predict or comprehend the contours of the various ordinances in Virginia’s 95 counties and 38 independent cities, CHP holders would be forced to forego their Right-to-Carry for fear of running afoul of an obscure or complicated local law.

HB1004 would prohibit those subject to a §19.2-152.10 protective order from possessing firearms. Those subject to a §19.2-152.10 protective order are already prohibited from purchasing or transporting firearms while the order is in effect. Unlike other protective orders that trigger a firearm possession prohibition, a petitioner for a §19.2-152.10 protective order does not need to bear any relation to the respondent.

The absence of a relationship requirement opens the §19.2-152.10 protective order procedure up to abuse. Verbal altercations between co-workers, neighbors, or less formal acquaintances where one party perceived, or claimed to perceive, the other as making a “threat” could result in the extinguishment of a person’s Second Amendment rights and the forfeiture of their firearms.

HB1083 severely restricts parental decisions about firearms in the home by making it a Class 6 felony to leave an unlocked and loaded gun in the home with a child or teenager under the age of 18. Current law only applies this restriction to children under the age of 14 and provides that the punishment for such conduct is a Class 3 misdemeanor. This law is unnecessary as Virginia already has a child abuse and neglect statute that provides felony penalties for parents who engage in dangerous conduct. (source)

Is it any wonder that parts of Virginia are considering secession from the state?

The protest meant nothing in the eyes of Virginia lawmakers.

The advancement of these gun laws is a slap in the face to every gun owner who has protested in person, written or emailed his or her members of Congress, and attended local meetings.

It shows that the people currently in office don’t care what Virginians have to say about the laws they pass. It underlines their blithe dismissal of the Sanctuary municipalities and of the massive peaceful protest that even saw protesters cleaning up the area before they left.

The protest may have meant nothing to lawmakers, but to gun owners, it meant everything. It means that people in Virginia will stand up for their rights. It means they will not back down. It means they’re willing to put themselves on the line to protect the 2nd Amendment in a state that still has a flag that says “Sic Semper Tyrannis.”

But as for the state government? You know, the one purchased by presidential candidate Michael Bloomberg?

This is not a government that represents the people of Virginia.

  • How do we say in these comment sections what needs to be said without having the wrath of the state come down on our heads. When politicians do not follow the will of their people they should be Tarred & Feathered, and run out of town on a rail. We must speak with one voice, and make sure those sick politicians fully grasp the situation they have placed themselves in.

    In other words; If you plan on fuquing your people with impunity you had better think twice because I am assured they have already had enough of your bull shEt. I would hope that Virginians make their point clear, because if you do not stand up against those sick socialist politicians they will eat your lunch.

    Just marching around your capital is no longer going to be enough. You must warn them of their debacle in no uncertain terms. PERIOD !

  • i think we all know what is coming i dont know who will break first or where that break will happen or how many other people will witness the triger event and be swept up in the moment and render aid to that beleigaurd person but the violence will travel fast a lot faster than the government could ever have a nightmare of they are so full of hubirus and hopped up on the power of the state that lives in the rags that they wear that they have forgotten there humanity they are so puffed up they look like peacocks ready to explode and all it takes to deflate them is just 1 small peice of metal traveling at a mere 300 meters a second and they instantly deflate and realize to late that the rags of power that they wear cannot and will not protect them from the ritious anger of the governed that they them selves forced into into action with their treasonous deeds and pompus actions ……

  • In February 2019, a very rare 9-0 decision by the US Supreme Court in Timbs vs Indiana ruled that the excessive fines and punishments protection of the US Constitution applies all the way down — from the federal level through the state, county and even city level. While it was about a civil asset forfeiture case, the precedent for applying US Constitutional protections that far down the bureaucratic chain was set. If the Virginia threat is not another example of grossly excessive punishments, then words have no meaning.

    The Institute for Justice that pursued and won the Timbs decision did the country an enormous favor. I sense another such opportunity to give the bought-off Virginia legislature a stern legal horse-whipping.

  • Given enough time. They will go door to door to take guns from the ones that got them legal and knows and follows the rules. These people in office will be voted out of office over all this mess. But will the new ones be able to reverse the red flag laws and all the rest of the new laws they are passing. Our protest meant nothing and they had no plans to hear what we had to say. Civil war? Maybe. Will have to wait and see what happens. There are a lot of things going on we have not heard about and none of it good. Our so called governor wants to change the terms from 4 years to 8 years. Not going to happen. He has to go.

  • A long time ago, a rat pack of self righteous bigots decided that everyone who had a beer or a glass of wine was somehow “responsible” when a violent alcoholic got drunk and hurt other people. So they rammed through Prohibition, shouted “hooray!” and patted each other on the back for a job well done.

    After all, EVERYONE would just blindly obey the law, right?

    Well….. NO, as it turns out.

    Prohibition failed because A) as it turns out, its not that hard to make booze. Even unlettered grade school drop outs can manufacture it. Turns out they’re also pretty good at making their cars go really, Really fast too. (ahem..NASCAR!!)

    and B) Law abiding people were not going to change their ways because a law got rammed through against their will. They were going to continue having that beer or wine or cocktail, and having concluded that the law was an ass, they simply thumbed their noses at it.

    The net result was a loss of respectful for the law in general, and people who wanted a drink kept right on drinking.

    Tell me, is there anyone stupid enough to doubt that THE EXACT SAME THING is going to happen in Virginia? Because as it turns out, building firearms is not exactly rocket science. And never mind folks living in the hollers and piney woods, how’s about illiterate peasants over in Afghanistan? Think they can make a gun all right?

    On top of which, folks who have been minding their own damned business and have never broken the law in their lives are going to look at this sanctimonious pile of horse shit oozing its ways through that long intestine called the Virginia Assembly and say “NO THANKS!”

    THEY WILL NOT COMPLY. Just like the folks in New Jersey, New York, California, and hell, let’s throw in New Zealand. They had the same evil, outrageous laws rammed through there, and most folks gave those laws the one finger salute.

    • PS In no way were any of my comments meant to be derogatory towards hill billies, red necks, backwoods dwellers, mountain folks or their counterparts over in Afghanistan. I’m just pointing out that if the ability to make booze and firearms is that widespread, then no amount of stuck up politicians in love with the sound of their own voice are going to be able to wave a magic wand and “Presto!!” remake the world as they see fit.

    • I agree that people will (hopefully!) just not comply with these idiotic laws. Whether the answer is voting them out in the next election or trying to force them out sooner, I think the first answer is to educate the entire state about nullification. Every jury has the right to vote ‘not guilty’ because of nullification. It is entirely legal to vote ‘not guilty’ in the case of someone who breaks these unconstitutional laws, because the law is a bad one. It is the people’s final way to say to law makers who think they can do whatever they want.

      So I think the first thing to do is sponsor an educational campaign about nullification. By the time the first arrest happens, give these folks a legal way to say ‘I will not comply’ without risking a conviction that will stop them from legally having a firearm for the rest of their lives. Fight the laws over time, but protect the people first.

  • The Congress and Senate in Washington do not consider themselves our
    Represenatives. They haven’t for a long time. They consider themselves rulers over us.

    This is the message several years ago when I had “breakfast with my reps.” I could tell the look in their eyes they really truly believe they rule over us peons.

    We really should have term limits, enforce conflict of interests, limit “donations” (bribes), have regular medical and retirement packages, not the extravagant perks they current voted in for themselves, test them for senility and illegal drugs (Cocaine comes to mind) and hold the one currently trying to pull off this coup (it is not a impeachment).

    We have allowed a entire elite caste to take shape inside DC and what was once a government service job is now a elite class of little kings and queens.

    Question: Why do Congressmen and Senators walk into their seats worth a couple hundred thousand and within a few years end up millionaires?

    • The U.S. Constitution was written to protect the elites (written and signed by and for white, landed, men). Citizens, over the years were able to modify (through non-violent and violent protest) its content to better protect and represent the will of the people. Over time those modifications have been eroded. The current monetary system, and therefore economic system, is governed by private banks – has been since 1913 when the Federal Reserve Bank was brought into existence by Congress. The banks print money they sell to the government with interest – hence, our government is a debt-based government that must always grow its economy so it can fund its debt. Of course in a finite world, infinite growth is not possible; it seems that the present reflects a ceiling in that growth so two things are happening, extraction of the remaining crumbs from citizens along with a default on debt through the devaluation of fiat currency by non-stop printing (currently to the tune of $60 billion per month plus the overnight and term Repo operations all feeding into the elite’s pockets via the banking system).

      My point – we don’t need to get back to our current Constitution, we need a new Constitution. A Constitution that ensures the crux of power begins and ends with the Citizens. A Community Based Constitution.

  • I could be wrong, but I have a feeling that harsh words we post online may one day be the excuse to trigger red flag laws against us. We all know the solution to this problem, and we know that we have no first amendment protections should we publicly discuss that solution. I wonder if the “dark” web has sites that reveal the physical addresses where America’s enemies rest their heads at night…

  • Take your counties and leave Virginia for West Virginia. You have been invited and you do not need the permission of the state or the US government. Sure they will probably sue, but the rule in the US Constitution sets up the possibility. There is nothing prohibiting it from occurring.
    After your counties join WV, it will have more population and will gain Congressional seats while VA will lose seats. VA will no longer be as important politically. Send a message that will reverberate throughout the land.

After they are voted out next election, and they will be, it’ll be hard if not impossible to reverse the damage tut hey have inflicted in our state. I’m leaning toward succeeding to west Virginia as his govenor has invited us to do so. That way Virginia can become the commonwealth of communism as they are trying to do.   • The first things to do are to make 100% sure that none of the ones who voted for these bills get re-elected. Then, ensure that the new legislators that take their places repeal all of what the previous scum enacted.
    Get patriotic judges installed, and bring bribery charges against anyone who took money from Bloomberg.
    Last, but not least, NEVER vote for any Democrat ever again.

  • Since the U.S. imports more than exports and Wal-Mart products mostly came from China, I’ll throw this out. Cardboard.

    The reason corrugated cardboard isn’t not allow on hospital patient floors is because they can contain nested insects, from worms to cockroaches and more. Cockroaches transmit multiple diseases. And insects, especially those that feed on blood, can be carriers of disease. The Medieval plagues were attributed to fleas carried by the Black Norwegian rat. Bedbugs once thought to have been eradicated to a controllable degree have made a comeback in the U.S. due their ability to mutate and adapt though multiple lifetimes, faster than the human lifecycle.
    Humans are colonized by various diseases that don’t surface until our defenses are down. Needless worry is a drain on your immune system.

    Water.
    John Muir wrote in his book “A Thousand Mile Walk to the Gulf “, 1867, he would stop to drink from a stream, pond, or puddle. Try that today without dire consequences. Sanitation Engineering is a relativity recent development. Around the 1880’s or so Chicago had a major sanitation problem from flushing their waste products into Lake Erie and the resultant backflow into the city’s water supply. Now algae blooms are a problem in lakes and offshore waters.

    Water is critical for life. Remember the rule of threes, three minutes to breathe, three days without water and three weeks (debatable) before death.

    It would be better to apply Prepper rules from the ground up rather from than from the top down. Better to secure your own water supply than depend on major utilities.

    Isn’t that what Organic Prepper is about?

    Better to concentrate on matters that you have some control on.

  • There are quite a few similarities between what is happening in VA and what happened here in CO. last year. 1)The enemies of the people (democommunists) controlled both houses of the State Legislature. They also controlled the Governor’s office. They were voted in by those in the larger cities, the front range on the I-25 corridor and the liberal mountain towns.
    2)The agriculture large land area of Colorado is still conservative, but the city folk only believe what the MSM tells them. SAD, that they don’t understand vigilance in monitoring what those in power want to do.
    3)Liberalism, Globalism, Democommunism are all mental diseases that can only be stopped by a couple things, People being informed and voting as informed freedom loving peoples. We have lost a lot of that, because to most people, Government handouts are GOD to the masses. I want nothing from Government except the fruits of my labor enjoyed by me and the government to do their job by upholding our Constitution and ensuring that our LIBERTY and FREEDOMS are protected and not stolen from us by them.
    4)IF we can not educate and share the history and means of liberty with the sleeping masses, then we will continue to lose freedoms until we are fully enslaved. Those in the State Houses across the nation, Those in the Deep State at the federal level are winning, but we Have THE LORD on our side if we accept JESUS CHRIST as our savior and repent. TO Win this battle we must have leadership of CHRIST and be prepared to fight when the Enemies Domestic throw down the gauntlet. I do not wish for battle, but will be prepared to fight it when the enemies leave us no choice and commit an atrocity against us.

Show them the evils permeating out of the LEFT and the RINO’s that have penetrated the Right as well. WE must take our nation back and through GOD’s GRACE and GUIDANCE we will be victorious. I hope we can do this through peaceful means, but if not, Constitutional actions might be needed. From the US DECLARATION of INDEPENDENCE: it states the following.

    • Well said! Our very own Declaration of Independence is so clear on this subject. The gubmint has become a monster that is seemingly unstoppable. Dem or Rep, doesn’t matter. Two heads on the same monster. We the People are being played by the globalists/elitists that see themselves as world rulers. The common folk have become pawns to them. They do not care what happens to the commoners. They give us continual Bread and Circus and many happily imbibe and think life is good! Incredible that so many have no knowledge of history past and have forgotten the wreckage of humanity that follows such corruption.

      It IS our right to throw off such a Despotic gubmint. Where to begin? Who will lead? I see stuff like this written all the time and yet current affairs just get worse. MLKjr had it right. Massive peaceful protest is a powerful weapon of change. He was murdered for speaking the truth and having the courage to institute it as well.
      The powers that be want it their way and will go to ANY means to enable that. Does anyone (including me) understand what a martyr is anymore? Is anyone willing?

      This all is so glaringly apparent these days. The powers that be are so sure that the masses are too dumb to understand what is happening. The kill list of those who speak up is long and growing. They don’t even try to hide much anymore. There is a HUGE elephant in the room and it is about to trample all who stand around just looking!

        You are so correct in your usage of “Bread and Circuses” . I have left this indoctrination with my wife and I purchasing our own little farm, raising our own chickens, growing a lot of our own food, getting ready to buy some beef cows. I have also left the world of government ordained and orchestrated circuses like the NFL, NBA, NASCAR and others due to their desire to support unconstitutional agendas like gun control, forced socialism, forced perversion with the likes of drag queen story hours, my stars, what are these parents thinking, taking their children to these things. I have seen video’s showing parents giving dollars to their kids to give to these things that are just destroying the innocence of childhood. WE have got to stand up for JESUS CHRIST, no matter what the world thinks of us. THAT is the only way we will be able to become victorious is through serving righteously and not being cowed by satanic forces of the minority. GOD BLESS to you and yours.

  • An old mule skinner was on his way to Richmond when he came across a farmer trying to get his mule to pull his wagon. The mule wouldn’t budge and the owner was at his wits end. He asked the mule skinner for assistance. The mule skinner got down off his wagon and took a large piece of hickory out from under the seat, walked up to the mule, and smacked him right between the eyes. The mule staggered, regained his footing, and the mule skinner told the owner that sometimes you just had to get their attention. When his owner slapped the reins to the mule he moved out down the road.

    A few miles further along the road the mule skinner ran into another farmer with a similar mule problem and he applied the same solution. Unfortunately this mule was just too stubborn and still wouldn’t move. The farmer asked what do we do now and the mule skinner told him that there is only one solution for a mule that stupid. The farmer pulled out his shotgun and shot the mule dead.

    The mule skinner was shocked and moved on towards Richmond thinking that he meant that the farmer might have elected to trade the mule.

    Does Virginia have more farmers or more mule skinners?

  • Oh, yes the legislature absolutely represents the people! They were voted in as a REBUKE to Donald Trump and his rabid, racist supporters! And the self-same rabid, racist supporters thought it was a fine idea to hold what was essentially a white supremacy march on MLK day. Absurd!
    The minute the gun lobby tied itself with this dog shit of a president that was the minute they became irrelevant as a political and cultural force among Americans.

  • Aside from the obvious violation of both the Second and Fourth Amendments, how would one beneath the tyrannical boot heel of a red flag law in Virginia simply “transfer” their firearms to another of age 21 or more and be in compliance with another of Coonman’s edits – universal background checks? A gunowner cannot transfer any firearm to another without first being subject to a state-mandated background check and a Form 4473….. FOR EACH FIREARM!

    What the tyrants have constructed is a spider web of new regulations that play off each other in such a tangled mess that the Second Amendment is defacto null and void.

  • This is a blatant example of just how corrupt the criminal justice system has become.
    USCC 18-241-242 specifically states that government representatives Cannot deprive persons of their Constitutional rights under color of law. It is a serious felony.

    So why isn’t their an official complaint filed by one of Virginna’s gun rights groups to see who the first public official is going to be to ‘aid and abet’ these criminal acts against the people so they merit official charges, and so on?

    Well, since it’s the district prosecutor’s office’s job to approve the charges after an official report and criminalcomplaint has been made to the Sheriff’s dept (preferably by a lawyer retained by the NRA, GOA, or some other useless so-called gun rights organizations), everybody will quickly see how intentionally conveniently ignorant everybody is about this esoteric law, and/or how treacherously corrupt and unaccountable their little justice criminal system really is, and how critical the need is for reform.
