Virginia Lawmakers Threaten 2nd Amendment Sanctuaries with National Guard

Virginia is the new battleground of the Second Amendment. After the most recent election, the state’s House and Senate are both Democrat majorities and they haven’t wasted a moment in attempting to gut the gun laws in what has historically been a permissive state.

What are these new gun laws?

The so-called “assault weapon ban” is SB16 and has that perilously vague wording we all know to be incredibly dangerous. In some interpretations, this law, if it passes, could make illegal the ownership or transportation of any semi-automatic gun because extendable magazines are available for it – and you don’t even have to have the extendable mags.

The Virginia Mercury reports:

The new Democratic majorities are expected to pass a variety of gun restrictions, including universal background checks, red flag laws that would allow authorities to take guns from people deemed dangerous and reinstatement of a one-handgun-a-month law…

…But the proposed ban on particular types of firearms — and the prospect of criminal charges for gun owners who didn’t give them up — seemed to stoke the strongest outrage in the 40-plus rural localities that have declared themselves Second Amendment sanctuaries within the past few weeks. Of the dozens of bills already filed for the session that begins in January, Saslaw’s assault weapon bill was the most-read, according to the state’s online legislative system. (source)

Since the above article was written, it should be noted that 2nd Amendment Sanctuary Counties are at 80 and counting. One sheriff has even vowed to deputize citizens should these unconstitutional laws pass.

After the public outcry, Governor Northam has said a provision will be added for current gun owners.

“In this case, the governor’s assault weapons ban will include a grandfather clause for individuals who already own assault weapons, with the requirement they register their weapons before the end of a designated grace period,” Northam spokeswoman Alena Yarmosky said in a statement Monday evening. Good try, but no cigar.

Gun owners aren’t going to take this lying down.

We’ve written before about Second Amendment sanctuaries popping up across the nation, and now Virginia is joining the fight. According to Gun Rights Watch, practically the entire state is saying NO.

These counties have passed resolutions vowing not to enforce unconstitutional gun laws. USA Today’s report refers to them as “publicity stunts” and “political statements.”

Richard Schragger, a professor at the University of Virginia School of Law, who focuses on the intersection of the Constitution and local law, told USA Today:

Rather than challenging an existing statute, the resolutions are “mostly expressive and symbolic” declarations, he said.

“In Virginia, state law supersedes local law. Citizens and local officials have to comply with state law even if a county declares itself to be a Second Amendment sanctuary,” Schragger added. (source)

It seems they may be underestimating the force of thousands of clearly well-armed and outraged Virginians if they think it’s just a publicity stunt. I’m pretty sure that the Virginians I know mean business.

Now the state legislature is threatening the sanctuary counties and officials.

Virginia Attorney General Mark Herring says that the gun owners are “being ginned up by the gun lobby” and had a few words to say about the rebellion.

“The resolutions that are being passed are being ginned up by the gun lobby to try to scare people. What we’re talking about here are laws that will make our communities and our streets safer. We’re talking about universal background checks, finally, maybe, Virginia will pass universal background checks to make sure that people who are dangerous, who are criminals and who aren’t permitted to buy guns, won’t be able to buy guns,” said Herring. “So, when Virginia passes these gun safety laws that they will be followed, they will be enforced.” (source)

How exactly do they plan to enforce those laws?

One representative hopes that the law enforcement officers will just resign.

“I would hope they either resign in good conscience, because they cannot uphold the law which they are sworn to uphold, or they’re prosecuted for failure to fulfill their oath,” Democratic Virginia Rep. Gerry Connolly told the Washington Examiner of local county police who may refuse to enforce future gun control measures. “The law is the law. If that becomes the law, you don’t have a choice, not if you’re a sworn officer of the law.” (source)

I’m 99.9% sure that any sheriff who has supported such a motion is not going to say, “Oh, it’s the law. My bad, Gerry.”

Rep. Donald McEachin believes cutting off state funds would do the trick, and if that doesn’t work he has another suggestion that is far more drastic.

McEachin also noted that Democratic Virginia Gov. Ralph Northam could call the National Guard, if necessary.

“And ultimately, I’m not the governor, but the governor may have to nationalize the National Guard to enforce the law,” he said. “That’s his call, because I don’t know how serious these counties are and how severe the violations of law will be. But that’s obviously an option he has.” (source)

Bringing in the National Guard to confiscate guns or override sanctuaries could only end one way: in bloodshed. Although, one must wonder whether the National Guard members would comply with the governor over their friends, families, and neighbors.

It’s going to get ugly fast. As serious as these legislators are about “getting guns off the street,” Virginians are equally serious about defending their right to bear arms.

It’s the ultimate game of chicken. It looks like we really have reached the point of “out of my cold, dead hands.”

Virginia gun owners, myself included, have no intention whatsoever of complying with this gun grab, and no conciliatory “you can keep them but you have to register them” gesture is going to suffice.

The only question remaining is, who’s ready to die on this hill?

  • Great article Daisy, and approximately 100 million other legal firearms owners will stand at your side to preserve our God given right to defend ourselves and families. No government can be legitimate when they take away the rights given by God and are specifically guaranteed in the Constitution; the government, Federal, State, or Local becomes illegitimate by the very attempt.

    Be that as it may, the Constitution supersedes ALL State laws. As a consequence, all sworn officers, military, etc., are sworn to defend the Constitution. Which means NOT enforcing unConstitutional laws.

    • SCOTUS won’t hear any cases for years. So unless a stay of the law is issued, it can be enforced. This is what happens when reasonable laws (such as a domestic abuser who does NOT live in the same home as his victim cannot buy a gun OR you have a hunting license you cannot buy a gun even if you are not a citizen) are fought tooth and nail by lobbyists and campaign contributors.

  • So, the Dummycrat Virginia Governor and his Bolshevik comrades in the Assembly want to use armed soldiers to force the people to give up their guns in the name of “public safety”.

    In other words, the people need to be protected from themselves because they’re too stupid to plan their own lives. Not too stupid to stop paying taxes to the tyrants with their collective boot on their necks, right?

  • Just wondering why the National Guard threat hasn’t been used against all of the immigration sanctuary counties that have popped up, or is that threat reserved for US citizens only?

    • The difference between anti-gun legislature and illegal immigration is the former is an violation of the 2ndA, by a tyrannical government to use force of arms against American citizens.

      The latter is addressed by the Constitution Article 1, Section 8.
      While some and the MSM label Trump a tyrant for putting kids in cages, it was the Obama admin that not only put kids in cages first, but also built the detention facilities. The Obama admin was declared by anti-immigration activists as “The Deporter-in-Chief” (Source: NPR, March 29, 2014, January 20, 2017).
      Obama and Trump were/are merely enforcing laws already on the books, and that previous admins chose to ignore.

Perhaps _he_ should be the one resigning “in good conscience” for not being able to uphold the law of the land.

  • I could see this going a few ways or a mix.

    NG members could resign en mass.

    NG members could refuse an unlawful order.

    NG members could have a massive “sick” out day, or just not show up at all.

    NG members could go door to door,
    “Excuse me sir/mama, but do you have any of those illegal weapons? No? Ok. Excuse me a moment, I have to “look” around your house for illegal weapons.”
    NG member takes several steps back. Looks at the base of the house, and then looks to the right edge of the house. Then up to the roof line. Then across to the left side of the house and down to the base. Then looks back to the starting point.
    “Ok, sir/mama. If any one asks, I was here, asked for your illegal weapons, and looked “around” your house for illegal weapons and found none. Thank you and have a good day!”

    Possible stand offs or shoot outs. That would be bad.

    The Governor could move NG units from outside of a given community to conduct searches and confiscations. The idea being those NG members and their families would be outside of that given community. Not sure if that would be better or not.

    If I were a member of the NG, I know I would not want to be in that position. I’d hand the Governor a rifle and body armor and tell the Governor to do it himself.

    Regardless, this should scare the crap out of every American. Not only does this violate the 2ndA, but the 4thA, and the 5thA. If they can do this with the 2ndA, what is stopping them from other abuses?
    Kinda has a Germany 1920-30s feel to it.
    This is what a tyrannical government looks like.

  • Article I contains the entire original Virginia Declaration of Rights from the 1776 Constitution. Several of the sections have been expanded to incorporate concepts from the United States Bill of Rights, including the right to due process, the prohibition against double jeopardy, and the right to bear arms

  • “Its the law”………..well…….nah…….the law has already been established betwixt the parties in the agreement known as the Constitution…….and the people of these several states………..they seem to believe they can simply decree a major change in the contract and we the people are obliged to just bend over and do as they say………naw,its at the consent of the governed………..not the decree of self made kings……….they violate the contract we dont have any obligation to it either and theyd do well to remember that it was the contract that put them where they are and violation of it negates any power we may have delegated to them……..its gonna get nasty before it gets better………..REB

  • It maybe that the gov of VA may find his own self occupied by the federals in this case……………as the federal govt is obligated to insure the people of VA and elsewhere a “republican form of govt”…..a violation of the rights of the people could set off a deeper set of events that they cant see coming……….REB

    • Finally a reasonable response. Yes, this will set off a deeper set of events, but it won’t be the presumed ‘streets of blood’ scenario people claim. While the governor is signing the confiscation bill into law on TV, the law will be coming up in one or more county/state courts for injunction. It will likely also appear in federal courts the same day. In an election year, I could see an executive order hitting the books too.

      This is all a big test of how far ‘shall not be infringed’ can in fact be infringed. The supremes already determined some infringement was implied in “shall not be infringed.”

  • I love these articles, but mostly I love the comments. I still haven’t figured out if this is a dog wag or not. We witnessed something very similar in NM a few months ago. Difference here is the threat has been increased to open confiscation talks.

    Which one of you is really going to die in your doorway, in front of your family, to defend your right to possess a piece of metal and plastic? It all sounds great, “live free or die” right?

    We have already seen more than one gun owner murdered for not giving up his fire arms, but still no revolution or civil war. Just a lot of righteous warriors pouring their angst onto the internet.

    So who’s taking odds on the county where the first black flag event happens if this bill becomes a law?

  • Folks, its my Sheriff here Virginia that has claimed he will deputize as many citizens as he needs too to help protect our 2nd amendment rights. Make no mistake about it, everything you’ve read here for years is quickly coming to a head. Almost 3,000 citizens showed up to a county meeting last night. The last time that many folks stood in the subfreezing weather until midnight was in the winter of 1863. The time to stock up/prepare/get fit was yesterday. The time to have that talk with your family was yesterday. The overall sentiment here is that there’s not but one way this is going to play out. It’s going to be attempted gun confiscation by the govt followed by the ensuing repercussions of Virginians willing to die on this hill for their liberty and their rights.

    • A lot of Virginians died on the hill during the Civil War for “the cause”. Very well may the same futile effort today. Stop drinking the Kool-Aid – the end game isn’t no guns despite what the NRA, 2nd amendment, Gun Owners for America etc. say. The NRA is imploding. Probably won’t be long before the other groups end up in the same place. The four legs of the red meat/wedge issues – or as I call them look here and ignore what else is going on – are on their last legs. Guns, god, gays, abortion – minority support with two, if not two and half generations of voters on the opposing side. Voting blocs whose number exceed the boomers and what is left of the silent generation, whose numbers decrease as I type.
      So time to decide if one is going to be a martyr for a lost cause or if one is going to be objective. Close the loopholes (including gun shows/sales in the parking lot) and non-military don’t need military guns OR face the sheer numbers of the voting age/upcoming voting age who may very well our lives a living hell. Don’t count on the judicial system as it won’t take much to neuter them.

In 2018 over 2.4 million of your states registered voters sat on their lazy asses and didn’t show up at the polls. Northam won. You don’t get out the vote guess what happens? You get Venezuela.

  • So Let me see. A law breaking illegal alien is protected by sanctuary cities and that’s ok. Yet rights protected by the constitution are not? The civil war can not happen fast enough, and people need to remember it’s the politicians that brought us to this point and hold them accountable first. This kind of stuff is not going to stop until we get rid of the Socialist cancer that is currently in power in so many places.
    Elections are a powerful tool, however when they fail, there are plenty of other tools.

  • The time has come. All militias need to start moving toward virginia. This is where it will start. The day has come. Virginia, send out the call for help. You will need numbers. All main roads, bridges, freeways need to be compromised. The day has come. you cannot wait any longer.

  • Its just like a tyrant to insist a constitutionally elected sheriff hold up to the oath the sheriff took to support and defend the Constitution while the tyrant took the same oath and does not adhere to it.
    The “gun laws” proposed are unconstitutional. An unconstitutional “law” is no law at all and should never be enforced if passed in the first place. Millions of Virginians know that. Why is it these puny political tyrants don’t know it?
    Virginia is comprised of 95 counties and 38 independent cities. To date, 91 localities have declared themselves as Second Amendment Sanctuaries, and more are scheduled to decide. This has all occurred in just the past two months! Impressive? Yes it is, and it clearly shows for all to see, including Northam if he has eyes, how Virginians interpret he and his cabal’s tyranny…. by those Virginians he was elected to serve, not to serve him!
    Should Northam elect to enforce his tyranny using the NG, there will be blood in the streets of Virginia. Rural Virginians are not the domesticated sheep of northern Virginia, Richmond, or Tidewater. Should Northam overplay his hand with the NG, the best outcome would be President Trump sending in federal troops to arrest Northam and his entire administration as well as any NG officer who complied with Northam’s orders.
    The State Motto of Virginia is “Sic Semper Tyrannous”….. Death to all Tyrants.

    like, where is the recall petiton that would be a slam dunk?. and if you think northam would not be recalled think again. look at the sanctuary count map again, and realize he would lose every one of thed res overwhelmingly.

  • When Leaders Threaten American Taxpayers it’s time to Hang the Bastards from a tree. VA, KY any other States that want to be free will do so.

  • A couple of things.
    If they bring force against the Virginians, half the South will be there, locked and loaded, to support the people.

    Secondly, the US can Federalize the National Guard and order them to stop following an unconstitutional order.

    Third, if they want more trouble, Trump could then enter the “Illegal immigration Sanctuary Cities” and arrest and deport every illegal from coast to coast.

    Do these leftists really want to push that button?

  • f we want to win the battle on gun rights we need to start by aggressively voting out every local council member who apposes it. Next we need to go-to Richmond and peaceful protest. We need to get tens of thousands of people. ” My county had over 3000 people at our board meeting alone. Next we need to start a recall election on strategic legislators. We need to let them know that their careers are over for even trying to pass these laws. Folks this is our one and only chance to protect our rights. If this works it will be a template to save our nation in every state. Our lives will be defined by how we respond to this challenge

  • The object of statutory law is the “person.” Person, at law, is defined as a legal entity. Are you a legal entity? Did you agree to be surety for or a representative of a legal entity? This is how they are able to circumvent the 2nd Amendment and its equivalent in the state Constitution. Those articles prohibit the making of law that would infringe upon an unalienable right of MAN. They do not address the civil rights of a person, so the legislature is free to enact a statute infringing on the civil rights of persons. This is crucial, you HAVE to understand this stuff!!!

  • Having read over the comments, I propose two hypothesis…

    One: the gun grabs are taking place in predominantly “Democratic” states. If Trump is impeached and removed from office, and Pence et Al are blocked from taking over the office, it would go to the speaker of the house, and we all know who that is. She is not likely to be overriding the Democratic governors in the gun grab attempts, and likely will use the NG to fully support them. This is not a coincidence.
    Two: Why the gun grab NOW, after years of fussing and threats that went nowhere? My thought is that this too is directly linked to the Democratic “coup”, and to the Agenda 2020 and 2030 compacts with the UN, which want everyone on board with their so-called climate change emergency program.

    I encourage everyone to do their own research on the subject of the Grand Solar Minimum period that we are now entering, as well as the crop failures experienced globally this past year.

    Please don’t reject these hypothesis unless/until you do your own assessment of the the issues and (deeper) motivations behind it all.

      While I have heard some things on the UN 2030 and 2040, I dont have a lot of faith in the UN at all. At. ALL.
      Now I do think that if you have a pool, and the swimmers keep peeing in it, and then add a few hundred swimmers (the pool is the earth, the swimmers are us humans, the pee is pollution), at some point, the water is going to turn yellow.
      But, if there is one thing that will impact weather on Earth, that is Solar Activity (or the lack there of).
      Put the two together and ya got a great big ol question mark. NO scientist, computer model can make a even reasonably accurate prediction.
      What I do know is to expect the unexpected.
      Grow the gardens larger, get an extra chicken or 12, rabbit or 3, extra hog or two.

  • Just as Governor Northam would do for a newborn who had survived a botched abortion, we should make him comfortable before we indict, prosecute, convict, and execute him for seditious treason against both the US and Virginia Constitutions, his oath notwithstanding.

      The president cannot over-rule the governor on use of the state national guard. The to federalize the state guard, the president essentially asks the governor to allow the federalization. The president doesn’t just swoop in and steal the national guard of a state.

      It will come down to the adjutant general of virginia to decide what he does in this situation. He’s an political appointee of the governor.
